This lawyer Richard Marcolus from Levinson Axeleod, expected me to go into court and sign something I had never read which contained a term I never agreed to or was ever told about.
Richard Marcolus and Levinson Axelrod added a Medicare Set Aside agreement into the agreed settlement.
I was never aware of this addition, didn’t understand what it was and had no clue. So when these already approved documents were presented, I had questions.
So after I began questioning, not the agreed settlement but how it was structured with a term never explained or had my consent to be added. After I was refusing something I didn’t understand, they sought to exploit my non-understanding …
These are emails from Richard Marcolus office, attempting to solicit a “YES” answer from me pertaining to a Medicare Set Aside Annuity which they already created without my consent. Soliciting a yes response in these emails was their solution to later saying I agreed. Because they knew I did not understand any of it. Also they knew my medical conditions, Major Depression, High Anxiety and PTSD. So not only did they attempt to exploit my non-understanding of the MSA and everything else surrounding it, they also were attempting to exploit a disabled person.
So when I get to court sometime in 2022 at the finalization hearing, the judge didn’t have anything to explain to me at all. After I noticed the settlement agreement had the MSA annuity, I refused to sign it and informed the judge, “I never agreed to that MSA annuity.”
Richard Marcolus clearly said she would explain why she put it in there, because he told me she added it … his own email says …

Judge wants me in court to explain?
Well that was in 2022 when I was at the final settlement hearing and guess what?
It’s now 2026 and counting, where is this explanation?
I was there in court in 2022 … and so was the court reporter, where’s this explanation?

So instead of the Judge Diana Monts resolving the issue, the insurer’s lawyer Christopher Brigeman, my Lawyer Richard Marcolus and the Judge Diana Montes … they get together and talk amongst themselves. Instead of resolving the issue, they seem to have come up with a plan to say I was not fit to manage my own money affairs. Because the judge instructed me that I would need a Doctors Medical note stating my competency? what? …
Ok so I say to myself, whatever, anything just to finally end this nightmare.
So I go to my Doctor and come back with the letter from him …
So I return with the letter, the Judge Diana Montes ignored it and didn’t address the outstanding issues.
After directing me to get the letter so that the case could effectively be resolved.
After following her directive, she ignored her own instructions.
So moving on, soon after I returned with the letter, to make an even longer story shorter …
